Terms of Service

1. Acceptance of Terms
These Terms of Service (the "Terms") form a binding agreement between you and Orbital Softworks ("we", "us") governing your download, installation and use of Qanvas, the Qanvas local builder, and this website (together, the "Service").
By installing or using the Service, or by purchasing a license, you confirm that you have read and accept these Terms. If you are accepting on behalf of a company or other organization, you represent that you have authority to bind it. If you do not accept the Terms, do not use the Service.
We may update these Terms from time to time. The effective date above shows the current version. Continued use of the Service after an update takes effect constitutes acceptance of the updated Terms.
2. Licensing
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use Qanvas on devices you own or control. Two license tiers are offered:
- Community license: covers personal, educational and evaluation use.
- Lifetime license: extends use to commercial projects, under the terms presented at the time of purchase and for the major version licensed.
- Neither license permits you to sell, sublicense, rent, lease, redistribute or publish Qanvas itself, to remove or alter proprietary notices, or to reverse engineer the licensing mechanism except where applicable law expressly permits it.
- We reserve all rights not expressly granted in these Terms.
3. Acceptable Use
You may use the Service only to build and publish lawful websites. You may not use the Service to create or distribute content that is unlawful, infringing, fraudulent, malicious or deceptive, or to circumvent license restrictions. You are solely responsible for the content you publish and for complying with the laws, regulations and third-party policies that apply to it.
4. Code Ownership
You own the websites, content, configuration and source code you create with Qanvas ("Your Output"). Qanvas generates standard, portable project files that are stored on your machine, and we claim no ownership of or license to Your Output.
Qanvas itself, including its block components, design recipes, tooling, documentation, name and branding, remains the property of Orbital Softworks and its licensors. Open-source components included in Qanvas remain subject to their own licenses, which apply to those components in place of these Terms.
5. Bring-Your-Own-Key AI Responsibility
Qanvas AI-assisted features operate with an API key that you supply from the AI provider of your choice ("BYOK"). Your key is used to send requests directly from your environment to that provider.
You are responsible for obtaining, securing and paying for your provider account and key, for all usage and charges incurred under it, and for complying with the provider's terms and acceptable-use policies. Your use of a provider is governed by your agreement with that provider, and we are not a party to it.
AI-generated output may be inaccurate, incomplete, offensive or infringing. You are responsible for reviewing all generated output before you rely on or publish it. We do not guarantee the availability, accuracy or fitness of any third-party AI service.
6. Payments
Paid licenses are sold through our payment processor, Stripe. Prices, taxes and the scope of each license are shown at checkout. By completing a purchase you authorize the charge shown and confirm that the payment details you provide are yours to use.
Except where applicable law requires otherwise or where stated at the time of purchase, fees are non-refundable once a license key has been issued. A license may be revoked for fraud, chargebacks or material breach of these Terms.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free or secure, that defects will be corrected, or that output generated with the Service will meet your requirements. You use the Service at your own risk and are responsible for backing up your projects.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORBITAL SOFTWORKS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE LICENSE GIVING RISE TO THE CLAIM. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
9. Termination
You may stop using the Service at any time. We may suspend or terminate your license if you materially breach these Terms. On termination your right to use Qanvas ends, but Your Output remains yours. Sections that by their nature should survive termination, including Code Ownership, Disclaimers, Limitation of Liability and Governing Law, will survive.
10. Governing Law
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the jurisdiction in which Orbital Softworks is established, without regard to conflict-of-law principles. The courts of that jurisdiction have exclusive jurisdiction over any such dispute, except where mandatory consumer-protection law gives you the right to bring proceedings elsewhere.
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. These Terms are the entire agreement between you and us regarding the Service and supersede any prior understanding.
